This is an action in tort, brought under the provisions of G. L. 4615, as amended by No. 128, Acts of 1921, to recover for damages claimed to have been sustained by the insufficiency of a culvert which the defendant town was liable to keep in repair. The defects alleged were the lack of capacity of culvert to carry off the water, so that it became clogged with snow and ice and allowed water to flow and freeze upon the highway over the culvert, and the lack of a suitable guard rail. There was a trial by jury, with verdict for the plaintiff, and the case is before us on defendants exceptions. These exceptions pertain to the refusal of the trial court to direct a verdict, to set aside the verdict, and to charge in accordance with certain written requests.
