This is an action for divorce by the plaintiff-respondent, Sybil June Martin, against the defendant-appellant, Ernest J. Martin.
The action was commenced by the service of a summons on August 16, 1966, and culminates, hopefully, with this opinion delivered
in March of 1970. In the interim many preliminary pretrial orders and trial preparatory maneuvers have been engaged in by
the parties, primarily at the instigation of the defendant. Including present counsel, four successive attorneys or firms
of attorneys have represented the defendant. A dubious appeal from a pretrial order was taken 1 and withdrawn after considerable
preparation. A contested trial was heard, taking two full days in November, and three full days in December, 1967. Upon request
of the parties, briefs were filed with the trial court, -- the last one was received February 13, 1968. On February 23, 1968,
the trial court filed an extensive written memorandum opinion. Findings of fact, Conclusions of law and judgment pursuant
to the memorandum opinion were filed April 23, 1968. The judgment awarded an absolute divorce to the respondent-wife, made provision for custody and support of the one child,
and ordered a division of estate, alimony and a contribution to the wife's attorney's fees.
